2. Acceptance of Terms

By browsing this Website, submitting our Contact Us form, or using the "Checkout via WhatsApp" feature, you confirm that you are at least 18 years of age (or using the Website under parental/guardian supervision) and that you agree to be bound by these Terms and our Privacy Policy.

3. Nature of This Website — Enquiry Model, No Online Checkout

This Website functions solely as a product catalogue and enquiry tool. It does not have a payment gateway and does not process online payments. When you add a product to your cart, tick the consent checkbox, and click "Checkout via WhatsApp," the product name(s) and quantity are sent as a message to our WhatsApp Business number. This does not constitute a confirmed order or a binding contract of sale — it is only the first step in placing an enquiry. A sale is finalized only once our team confirms product availability, final pricing, customization, payment terms, and delivery details with you directly, in writing, via WhatsApp, phone, or email.

4. Products, Pricing & Bulk/MOQ Orders

• All products shown are subject to availability and may be ordered individually or, where you select the "Bulk Order" option, as a bulk enquiry (final quantity to be confirmed directly with our team).
• Certain products or categories may carry a Minimum Order Quantity (MOQ), especially for customized, corporate, or wedding bulk gifting — this will be communicated to you at the enquiry stage.
• Prices, where displayed as "As Per MOQ" or similar, are indicative only; final pricing (including applicable GST, if any) is confirmed in writing before order confirmation and is subject to change without prior notice on the Website.
• Actual products (especially handcrafted or silver items) may vary slightly in finish, weight, or design from Website images due to the nature of the material and customization — see our Disclaimer for details.

5. Order Confirmation & Contract Formation

Under the Indian Contract Act, 1872, a valid contract requires offer, acceptance, and consideration. An order is considered confirmed only when the following are mutually agreed in writing (via WhatsApp or email): product specification, quantity, and customization details; final price and payment terms; delivery address and timeline; and advance payment (if applicable) received. Simply adding items to cart, sending a WhatsApp enquiry, or submitting the Contact Us form does not, by itself, create a confirmed order.

6. Customization / Engraving

For customized or engraved products, you are responsible for confirming and approving all names, spellings, dates, and design details in writing before production begins. Once production has started, such orders generally cannot be cancelled or modified — see our Refund & Cancellation Policy for full details.

7. Payment

All payments are arranged and collected directly by Neev Gifting outside the Website (e.g., via UPI, bank transfer, or another mutually agreed mode), only after an order is confirmed in writing. We do not collect any payment information through the Website, and we are not responsible for any payment made to any party other than Neev Gifting through officially confirmed channels.

8. Shipping & Delivery

We ship across India and internationally. Delivery timelines communicated at the time of order confirmation are estimates and may vary due to customization, courier delays, customs (for international orders), or circumstances beyond our control. Any customs duties or import charges on international orders are the customer's responsibility. Risk of loss passes to the buyer upon dispatch from our facility, unless otherwise agreed.

9. Cancellations, Returns & Refunds

Governed separately by our Refund & Cancellation Policy, drafted in accordance with the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.

10. Consumer Rights & Grievance Redressal

In accordance with the Consumer Protection Act, 2019, complaints will be acknowledged within 48 hours and resolved within 30 days. You may also approach the appropriate Consumer Disputes Redressal Commission, or file a complaint via the National Consumer Helpline (1800-11-4000 / consumerhelpline.gov.in).

11. Intellectual Property

All content on this Website — product images, descriptions, logos, and designs — belongs to Neev Gifting and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. Unauthorized use or reproduction is prohibited.

12. Limitation of Liability

Our total liability in any dispute is limited to the value of the specific confirmed order in question. We are not liable for indirect or consequential damages, delivery delays caused by third parties, or minor natural variations inherent to handcrafted products. Nothing here limits liability for death, personal injury, or fraud caused by our negligence.

13. Force Majeure

We shall not be liable for any delay or failure to perform our obligations if such delay or failure results from causes beyond our reasonable control, including but not limited to natural disasters, strikes, government restrictions, courier/logistics disruptions, pandemics, or other events of force majeure.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts at Surat, Gujarat, India, without prejudice to your rights under the Consumer Protection Act, 2019.

15. Severability & Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, Refund & Cancellation Policy, and Disclaimer, constitute the entire agreement between you and Neev Gifting regarding your use of this Website.

We may update these Terms at any time; changes take effect upon posting here with a revised date.
